The Noel/Thomas indictment (Case 1:19-cr-00830-AT, doj-ogr-00021922) establishes that no correctional officer conducted any count or round of the SHU from approximately 10:30 PM on August 9 until 6:30 AM on August 10. TRUINTEL logs confirm: last logged activity was a 9:30 PM medical visit ("GAVE INMATE HIS MEDS"), with no entries until 8:35 AM on August 10 -- after the death was discovered.
Noel was the last person to approach Epstein's tier at 10:30 PM, briefly walking to the door and walking back (EFTA00118859). Surveillance footage (bates CH0080_20190809215956) shows her 10 PM count took approximately 6 minutes.
During the 8-hour gap, Noel and Thomas sat at a desk, browsed the internet (furniture sales, motorcycle sales, sports news), and appeared to sleep for approximately 2 hours. Noel completed and signed more than 75 separate 30-minute round entries falsely. At 6:33 AM, the alarm activated. Noel told Supervisor-1: "Epstein hung himself." Thomas stated: "we messed up" and "I messed up, she's not to blame, we didn't do any rounds."
An email from August 7, 2019 listing vacant posts for the weekend of 8/10-8/11 explicitly shows 10 South 2 as vacant for Day Watch Saturday (EFTA00036756). Multiple SHU posts were also vacant. Staff on the death weekend were overtime replacements, not regular staff. The OIG report confirmed BOP had "repeatedly found the need to address staffing shortages" since 2015 with "direct impact" on Epstein's death circumstances.
Noel and Thomas were charged (19 Cr. 830) but the case was disposed via nolle prosequi on December 30, 2021 (EFTA00023097). Noel accepted a deferred prosecution agreement (EFTA00089505). Neither guard served prison time.
WHAT THIS SHOWS AND DOES NOT SHOW: An 8-hour unmonitored window, endemic staffing shortages, falsified records, and dismissed charges are documented facts. The OIG report explicitly links staffing failures to the death circumstances. The documents do not establish whether the institutional failures were orchestrated or were pre-existing conditions exploited by circumstance.
